RENTAL & EVENT TERMS AND CONDITIONS

1. Introduction
Welcome to ArchWizard. These Rental Terms and Conditions (“Terms”) govern the rental and provision of gaming-related equipment, accessories, and event-based services (“Products” and “Services”) by ArchWizard.
By placing a rental order, accepting an invoice, making payment, or taking delivery of any Products, you agree that these Terms constitute a legally binding agreement between you and ArchWizard. If you do not agree to these Terms, you must not proceed with any rental or use of the Products.
ArchWizard reserves the right to amend these Terms at any time. Continued use of the Services after publication of revised Terms constitutes acceptance of such revisions.
2. Definitions
“ArchWizard”, “we”, “us”, or “our” means ArchWizard.
“Customer”, “you”, or “your” means the individual or entity renting Products or engaging Services.
“Products” means all gaming-related equipment and accessories rented from ArchWizard.
“Services” includes rental services, delivery, setup, event support (if any), and customer support.
“Rental Period” means the period stated in the invoice, inclusive of delivery and return time.
“Event Rental Services” has the meaning given in Section 5A.
“Damages” includes loss, theft, destruction, misuse, or deterioration beyond normal wear and tear, as determined solely by ArchWizard.
All other defined terms shall bear the meanings assigned elsewhere in these Terms.
3. Scope of Agreement
These Terms apply to all rentals, including individual use, corporate use, event-based rentals, and short-term or long-term rentals.
Any additional terms stated in quotations, invoices, WhatsApp messages, or written confirmations shall form part of this agreement. In the event of conflict, these Terms shall prevail unless ArchWizard expressly agrees otherwise in writing.
4. Rental Process
(Sections 4.1 – 4.11 remain substantively the same but are deemed incorporated in full and strengthened by Sections 11, 13, 14, and 5A.)
ArchWizard reserves the right to refuse, suspend, or cancel any rental at its discretion if it reasonably believes there is risk of non-payment, damage, misuse, or legal exposure.
5. Products and Services Offered
ArchWizard rents gaming consoles, VR equipment, controllers, gaming chairs, peripherals, and related equipment, and may provide delivery, setup, and technical assistance where agreed.
No representation is made that Products are fit for any specific purpose beyond ordinary consumer use.
5A. Event Rental Services
5A.1 Scope
“Event Rental Services” means the rental of Products for use at events including corporate events, exhibitions, roadshows, school events, private functions, and public or semi-public gatherings.
5A.2 Client Responsibility and Control
The Customer shall have full care, custody, and control of the Products for the entire Rental Period, including during events, setup, use, and teardown.
The Customer is solely responsible for:
Venue suitability and safety
Crowd management and supervision
Compliance with laws, permits, and venue rules
5A.3 Third-Party Use
Products may be used by event attendees (“Event Users”). The Customer assumes full responsibility and liability for all acts, omissions, and conduct of Event Users.
5A.4 No Liability for Injury
To the maximum extent permitted under Singapore law, ArchWizard shall not be liable for any injury, death, personal harm, discomfort, or health-related claims suffered by the Customer or any Event User, howsoever arising, including during VR or interactive gaming use.
5A.5 Damage and Loss
The Customer shall be fully liable for all loss or damage to Products, venue property, or third-party property occurring during the Event Rental Services, regardless of cause (except normal wear and tear as assessed by ArchWizard).
5A.6 Cross-Reference – Insurance
The Customer acknowledges and agrees that:
ArchWizard provides no insurance coverage (see Section 11); and
The Customer is strongly encouraged to obtain public liability and event insurance.
5A.7 Cross-Reference – Liability and Indemnity
Sections 13 (Limitation of Liability) and 14 (Indemnification) apply fully and without limitation to Event Rental Services.
6. Rental Period
Failure to return Products by the end of the Rental Period may result in:
Additional daily charges
Forfeiture of deposit
Legal recovery of replacement cost
7. Fees and Payment
All fees are strictly non-refundable once the Rental Period has commenced.
ArchWizard may offset unpaid charges against any deposit without prejudice to further rights.
8. Security Deposit
Security deposits may be partially or fully forfeited at ArchWizard’s discretion where Damages, loss, or breach occur.
9. Delivery and Return
Risk in the Products passes to the Customer upon delivery or collection, whichever occurs first, and remains with the Customer until accepted by ArchWizard upon return inspection.
10. Product Condition
ArchWizard’s assessment of condition, damage, and repair cost shall be final and binding.
11. Insurance
11.1 ArchWizard does not provide insurance of any kind.
11.2 The Customer bears all risks and is responsible for arranging adequate insurance, including third-party liability coverage for events.
11.3 Failure to obtain insurance does not reduce the Customer’s obligations under Sections 13 and 14.
12. Customer Responsibilities
The Customer must ensure safe, lawful, and proper use of Products at all times and shall be responsible for all consequences of misuse.
13. Limitation of Liability
13.1 ArchWizard shall not be liable for:
Personal injury or death
Loss of profit or revenue
Indirect or consequential loss
13.2 ArchWizard’s total aggregate liability shall not exceed the fees actually paid for the relevant rental.
13.3 These exclusions apply regardless of theory of liability, whether in contract, tort, negligence, or otherwise.
14. Indemnification
The Customer shall fully indemnify and hold harmless ArchWizard against all claims, losses, liabilities, damages, costs, and legal fees arising from:
Use of Products
Event Rental Services
Injury or death
Property damage
Breach of Terms
This indemnity survives termination.
